They are seeking a Patent Attorney to improve AI systems' ability to perform complex legal reasoning in U.S. patent prosecution, focusing on continued examination and after-final practice before the USPTO.
Responsibilities
- Drafting Requests for Continued Examination and accompanying responses/amendments
- Responding to non-final and final office actions, and after-final practice (AFCP 2.0, advisory actions)
- Claim amendment strategy and argument drafting to overcome §§ 101, 102, 103, and 112 rejections
- Prior-art analysis and application of references to claim limitations
- Information Disclosure Statements (IDS) and examiner-interview strategy
- Evaluating whether to pursue RCE, appeal to the PTAB, or continuation practice
- Evaluating AI-generated patent prosecution arguments for accuracy and completeness
- Creating structured, multi-step patent reasoning tasks
Skills
- Registered to practice before the USPTO as a patent attorney or patent agent (active or previously held USPTO registration number) — a JD is welcome but not required
- Technical or scientific degree qualifying for the USPTO patent bar (engineering, physical/life sciences, computer science, or equivalent)
- 3+ years of U.S. patent prosecution experience
- Direct, hands-on experience preparing Requests for Continued Examination and responding to office actions
- Ability to analyze examiner rejections and identify legal and technical issues and risks
- Substantial experience with after-final practice and RCE strategy
- Depth in obviousness (§ 103), anticipation (§ 102), eligibility (§ 101), and § 112 analysis
- PTAB appeal or ex parte appeal experience informing prosecution decisions
- Examiner-interview experience and demonstrated success overcoming rejections
- Prosecution experience across one or more high-volume art units or technology areas
- Familiarity with USPTO prosecution tools (Patent Center, Patent Public Search, PAIR/USPTO systems, Espacenet)
