They are seeking experienced trademark litigators and TTAB practitioners to design and evaluate realistic legal tasks reflecting professional trademark litigation and TTAB workflows.
Responsibilities
- Drafting notices of opposition, petitions to cancel, answers, and affirmative defenses
- Likelihood-of-confusion analysis under the DuPont factors, plus priority, use-in-commerce, and distinctiveness analysis
- TTAB discovery and trial practice (initial disclosures, interrogatories, requests for production, motions to compel, notices of reliance, testimony declarations)
- Motion practice and trial briefs (summary judgment, motions to dismiss, suspension pending civil action; case-law synthesis)
- Evaluating AI-generated trademark arguments for accuracy and completeness
- Creating structured, multi-step trademark reasoning tasks
- Grading model outputs and providing structured feedback to improve performance
Skills
- Juris Doctor (JD) or equivalent U.S. law degree
- Active or previously held U.S. license to practice law, in good standing
- 3+ years of trademark litigation or contested-proceedings experience
- Direct, hands-on experience with TTAB opposition and/or cancellation proceedings
- Ability to identify legal issues and risks in complex trademark disputes
- First-chair or substantial role in TTAB oppositions or cancellations
- Trademark infringement, dilution, or unfair-competition litigation in federal court
- Depth in likelihood-of-confusion (DuPont) and priority analysis
- Trademark prosecution and clearance experience informing contested matters
- Familiarity with the TBMP and the Lanham Act
- Familiarity with trademark research and filing tools (USPTO Trademark Search, TSDR, TTABVUE, ESTTA)
